The Insurance Company "Statement"
Inevitably, the insurance company adjuster will want to take your statement after an accident. He or she will tell you that it is needed for the file. Hopefully, by the time they "pop the question," you will have already been in touch with a competent personal injury lawyer, who will advise you to politely decline. While your story will be told, how and when is an important piece of the puzzle, which your lawyer should control. Just yesterday, after having received our demand package, an adjuster called and informed me that she could not properly respond until she had my client's statement for her file. I told her I would be happy to meet her insured with a videographer and my client at the scene of the accident, with all the witnesses, and take all of the statements for the "file." She dropped her request and promised an offer within the week. The lesson here is that it is more likely that the adjuster doesn't really need your statement for the file; rather, he or she is hopeful that you will make a mistake and say something to undermine your case.
